·   This policy (the “Privacy Policy”) describes what information is collected from users of this website and any related sites and applications that we own or operate (the “Platform”), and explains how the information is used and how it can be updated or deleted. Any defined terms used in this Privacy Policy and not otherwise defined herein have the meanings set forth in the Customer Terms.

 

I. Use of Personally Identifiable Information

BillsaverUSA may use your personally identifiable information as follows:

·        to bill you and collect payment for Services;

·     to perform customer support functions and respond to issues arising from the Services and your use of the Platform

·   to improve our marketing and promotional efforts, analyze Platform usage, improve our content and service offerings, and customize our content, layout, and the Platform;

·     to identify and inform you about services and products from BillsaverUSA and BillsaverUSA’s business partners that may be of interest to you, including by using targeted banner advertisements and sending communications relevant to your use of the Platform and/or Services;

·        for troubleshooting problems, detecting and protecting against error, fraud or other criminal activity, enforcing our Customer Terms, and meeting our legal and regulatory obligations;

 

 

II: Disclosure of Information

Unless you provide your affirmative consent, BillsaverUSA does not sell your personally identifiable information. The following is a non-exhaustive description of the ways that your personally identifiable information may be disclosed in the normal scope of BillsaverUSA’s business:

1. To Your Providers

The Services you request may require us to contact providers of products and services to you in order to negotiate on your behalf. In the course of performing these Services, we may share certain identifying information you provide to us with these providers.

2. To Our Internal Service Providers

We may use third parties that we refer to as internal service providers to facilitate or outsource one or more aspects of our operations or the Services or Platform that BillsaverUSA provides to you (e.g., technology, payment processors, newsletters/alerts, analytical tools, advertising campaign management) and therefore BillsaverUSA may provide some of your personal information directly to these internal service providers. 5. For Legal Reasons

We reserve the right (and you authorize BillsaverUSA) to share or disclose your personally identifiable information when BillsaverUSA determines, in its sole discretion, that the disclosure of your personally identifiable information is necessary to identify, contact, or bring legal action against you if:

6. BillsaverUSA Reorganization

Personally identifiable information and other personal information collected from you may also be transferred to a third party as a result of a sale, acquisition, merger, reorganization, other transfer or bankruptcy (a “Transfer”) involving BillsaverUSA. BillsaverUSA cannot ensure that all of your private communications and other personally identifiable information will never be disclosed in ways not otherwise described in this Privacy Policy. By way of example (without limiting the foregoing), BillsaverUSA may be forced to disclose personal information to the government or third parties under certain circumstances or third parties may unlawfully intercept or access transmissions or private communications. V. Newsletters and CAN-SPAM Compliance

BillsaverUSA sends only verified, opt-in e-mail newsletters, specifically requested by subscribers. Subscriptions to our newsletters are verified by sending an e-mail confirmation to your e-mail address, which requires a positive response before an e-mail address is added to our newsletter list. BillsaverUSA is fully compliant with the Controlling the Assault of Non-Solicited Pornography and Marketing Act of 2003.

VI. Use of Tracking Technology

1. Cookies

BillsaverUSA utilizes “cookies” in connection with provision of the Platform and Services. A cookie is a small text file that is stored on your computer for record-keeping purposes. A cookie does not identify you personally or contain any other information about you but it does identify your computer. In certain areas BillsaverUSA uses industry-standard SSL-encryption to protect data transmissions. In the unlikely event that an unauthorized third party compromises BillsaverUSA security measures, BillsaverUSA will not be responsible for any damages directly or indirectly caused by an unauthorized third party’s ability to view, use or disseminate such information.

XI. Opt-Out and Changes to Personally Identifiable Information and Use Preferences

This Privacy Policy may be published in a number of languages for information purposes and ease of access by customers. It is only the English version that is the legal basis of the relationship between you and BillsaverUSA, and in case of any discrepancy between a non-English version

XIII. Dispute Resolution

This Privacy Policy is a part of the Agreement that you enter into with us by accessing or using the Platform or requesting or receiving Services. As such, it is subject to the dispute resolution provisions of the Agreement as set forth in the Customer Terms.

AS A PARTY TO THE AGREEMENT, YOU ARE AGREEING THAT ANY DISPUTE OR CLAIM ARISING OUT OF OR RELATING TO THIS PRIVACY POLICY SHALL BE RESOLVED BY FINAL AND BINDING ARBITRATION IN ACCORDANCE WITH THE CUSTOMER TERMS. YOU ARE GIVING UP YOUR RIGHT TO HAVE A TRIAL BY JURY, YOU ARE GIVING UP YOUR RIGHT TO SERVE AS A REPRESENTATIVE, AS A PRIVATE ATTORNEY GENERAL, OR IN ANY OTHER REPRESENTATIVE CAPACITY, OR TO PARTICIPATE AS A MEMBER OF A CLASS OF CLAIMANTS, IN ANY ARBITRATION OR LAWSUIT INVOLVING ANY DISPUTE WITH BILLSAVERUSA ARISING UNDER THIS PRIVACY POLICY AND YOU ARE AGREEING THAT YOU MUST FILE ANY CLAIM WITHIN ONE (1) YEAR AFTER SUCH CLAIM AROSE OR IT IS FOREVER BARRED.
